Open Question: Another Mortgage/forclosure question?

My Husbands ex was suppose to sell or refinance home in 90 days..did not happen. She quit making payments, We stepped in made them to save his credit,gave offer to her for house she refused, took her to court judge said payments were a gift and he could not make her sell to us. House got forclosed went to aution did not sell....now you say were still responsible...can we go back and ask to buy the house from the mortgage company as a forclosure and save his credit? And NOT have her name on there?
