Default Open Question: IN CONTEMPT?? Please help!!?

In NC, my ex husband was ordered on October 15th 2007 to refinance or sell marital residence using his best efforts, also to make mortgage payments on a timely basis. I filed a motion to show cause, I have an order for ex to be present in court on June 2nd. His attorney told me that as long as he has the most recent payment up to date that he can not be held in contempt. Even thought I have proof/documents from mortgage company and my credit report that the defendant has been late for the past 6 months! Please Help!! Deperate for an Answer!!
