A company refinanced a mortgage using a higher balance mortgage rather than the one intended in the contract. After they paid the intended mortgage a month later because we caught their error, they say we need to repay them. However, we cannot get another loan with as low of interest as the one they paid in error. Can we claim the over amount paid into refinance as damage?
