Default Open Question: taking the load....but should the money be divided in 3?

my fiance is planning to take over his dads house (who has past away'01) his mother is still paying the mortgage off this house ist over 45 yrs!! when his dad was alive he owed alota $ after his mother has refinanced a trillon times now owes over 290,000! She has refinanced for several things, fixing up the house, putting his TWO OLDER BROS through college( which they both have their masters degrees now) pay bills, paying off debt. loans etc. My fiance is back in the house and he and his OLDEST brother are contributing to her mortgage. Now that my fiance has moved in. His oldest brother feels that he has saved enough money living with his mom to move to so.Cali with HIS "fiance".... Leaving MY fiance with the financial responsibility for the house and his mom! which he dnt mind cause he wants to keep the house ne way. but now his BROS are telling him to refinance and spilt it 3's THEN he can keep the house THAT DOESNT NOT SOUND FAIR! DOES IT? ps. in the long run im paying it off too!
